The lawsuit targets Colorado’s HB2,513 law, which defines ‘gender expression’ to include ‘chosen name’ and ‘how an individual chooses to be addressed.’ The company claims the law would restrict their ability to promote their message about gender identity and trans athletes in women’s sports.
Jennifer Sey, the founder of XX-XY Athletics, argues that the law poses a threat to free speech and the mission of empowering female athletes. The state’s attorney general has declined to comment on the lawsuit. Additionally, Colorado is facing a lawsuit from a school district over its policies allowing trans athletes in girls’ sports, highlighting the ongoing legal and political tensions surrounding these issues.
