An Italian retro gaming YouTuber, Once Were Nerd, has been targeted by Italian customs officers for reviewing gaming handhelds, leading to a potential jail sentence under strict copyright laws. The investigation began on April 15 when officers from the Guardia di Finanza arrived at his home and office with a search warrant to examine the promotion of pirated copyrighted materials. Over 30 ANBERNIC, Powkiddy, and TrimUI handhelds were seized during the raid, with the creator complying by providing full transcripts of his communications with manufacturers. His phone was also taken, though it was returned two months later on June 15. The case, which could involve charges under Article 171 ter of the Italian Copyright Law, may result in a maximum penalty of 15,000 euros and up to three years in prison. The law, originally written in 1941, remains largely unchanged, raising questions about its applicability to modern digital content distribution. Unlike YouTube copyright strikes, there is no clear remedy if the creator is found guilty, and the possibility of his channel being shut down before a verdict poses a significant risk to content creators.
