The King County Department of Adult & Juvenile Detention is challenging Washington state employment law that bars hiring unauthorized immigrants, following a whistleblower complaint alleging dozens of unqualified jail guards were hired. This issue has sparked significant debate over immigration policies and law enforcement practices. The whistleblower investigation started in early October when an unnamed employee submitted a complaint to the state’s Criminal Justice Training Commission. The complaint claims that several hires lacked legal work authorization, violating state law. The department’s director, Allen Nance, is reportedly suing to have the law struck down, arguing it is unconstitutional and discriminates against local officers.
The state law requires all peace officers in Washington to have their immigration status verified and must be American citizens, lawful permanent residents, or beneficiaries of the Deferred Action for Childhood Arrivals (DACA) program. This law prohibits the hiring of individuals with temporary visas, expired work authorization, or those who do not fall under DACA. The state’s training commission told Fox News Digital that while it trains newly hired corrections officers, the responsibility of vetting candidates lies with the hiring agencies. However, after learning of the whistleblower complaint, county officials informed the commission that four recent hires did not meet eligibility requirements and were expelled from the training program.
King County is the largest in the state, encompassing Seattle and its suburbs. Local authorities have been cooperating with the state investigation, according to a WSCJ, spokesperson previously said. The department previously denied that any of the guards were illegal immigrants, even though some appeared to have failed to meet legal eligibility requirements. Nance’s legal challenge highlights the ongoing tension between state and federal immigration policies and the implications for law enforcement practices. This situation underscores the complex legal and ethical issues surrounding the employment of immigrants in public safety roles.
